1.  Fronius International GmbH, Vorchdorfer Strasse 40, A-4643 Pettenbach (“Fronius“), is operator
of the DownloadCenter. The DownloadCenter is a web-based information and communication service by Fronius.  Fronius does not assume any liability for errors, which may occur while using the communication service “DownloadCenter”.
 
The users of DownloadCenter hereby irrevocably declare to agree with the General Terms of Use / Licence in the respective applicable version. These can be found at any time under the link “Legal Notice”.
 
2. In DownloadCenter Fronius provides information regarding its products, general information about welding technology as well as all other information and continuously provides information about current developments regarding Fronius products and services. The selection of content exclusively rests with Fronius. Although all content is carefully reviewed Fronius does not assume any guarantee regarding the up-to-datedness, accuracy, completeness and/or quality of the information made available.
 
3. Fronius expressly reserves the right to change or amend the content of DownloadCenter without special notice at any time as well as to upload parts thereof contemporarily or definitively.
 
4. All brands, features and trademarks announced in DownloadCenter are subject to the regulations of the respective applicable trademark law. Any violations thereof lead to criminal law and civil law procedures. Texts, diagrams, etc. uploaded onto DownloadCenter, which have been drafted by Fronius, are particularly protected by copyright for Fronius; any use or utilisation may only occur following the written consent by Fronius.
 
5. The users have the possibility to order goods via the communication service “DownloadCenter”.
A purchase contract only comes into existence if Fronius accepts the order in writing or by email.
Such orders are subject to the General Terms and Conditions for Payment and Delivery by Fronius in the respective applicable version.

6a) The user undertakes to keep all information and models strictly confidential, of which in the course of using DownloadCenter the user gains knowledge of directly or indirectly or which are made available to the user, and not to reveal or make otherwise available these to third parties without the written consent by Fronius. The information in DownloadCenter is exclusively for the use of the user.

6b) Furthermore the user undertakes to use the confidential information exclusively for the purpose foreseen herein and not to make any commercial use thereof, except in the event of written consent by Fronius.
6c) No licence, user or similar rights to any patent, patent application or knowhow may be deduced from this agreement, either directly or indirectly.
6d) Any and all confidential information, including any and all protected and other rights created and/or produced in connection with the confidential information provided, no matter when or by whom, are the exclusive property of Fronius. The user cannot deduce any rights from knowing the information and knowhow in respect of applying for protected rights against Fronius, particularly in terms of prior use.

7. The user assumes liability for information/messages uploaded onto the communication service.
The user undertakes to refrain from any conveyance, distribution and provision of content in so far as it may constitute a criminal and indecent action. The user undertakes to observe the relevant legal provisions and in the event of violations thereof to hold Fronius free of damages and claims.
 
8. Fronius reserves the right to delete contributions by users without giving any reasons.
 
9. Fronius hereby expressly declares that the conveyance, distribution and provision of certain content, in particular content of obscene and extreme right-wing nature, may constitute criminal offences notably in accordance with the pornography law, prohibition law and criminal code.
 
10. Links within DownloadCenter, be it in form of hyperlinks, advertising banners, etc. do not represent a recommendation for third parties, Fronius dissociates itself from the content of linked sites. Any liability for the content of linked websites is – in so far as legally permissible – expressly excluded. If a linked site contains questionable content we request notification; in such an event the corresponding link will be deleted after examination.
 
11. Fronius reserves the right to exclude a user with immediate effect and without prior warning from accessing DownloadCenter, if there is reasonable suspicion that network activities originate from the connections of a user, which either constitute a danger for the safety or operation of DownloadCenter and/or other equipment of Fronius or of other users. Furthermore, Fronius reserves the right to charge the costs for detecting and tracking the activities, disrupting the connection and any repairs.
 
12. Any registered user is responsible towards Fronius for all activities (e.g. uploading messages), which are performed by using the access code (password) of the user. Passing on the access code to third parties is expressly prohibited and leads to liability for compensation.
 
13. The liability of Fronius towards third parties or the user, above all claims for compensation due to damages of any kind are excluded, unless the damaged party can provide evidence that the damage caused by Fronius was intentional or grossly negligent. The total liability for gross negligence per claim is limited to 1,500. - euro.

14. The licence agreement for DownloadCenter is applicable until revoked by Fronius. Fronius reserves the right to terminate entirely the operation of DownloadCenter without giving any reasons.
